GROWING COMPLAINTS AGAINST PUBLISH AMERICA LLP




Please be sure to read the F (Failure) Rating Report from the Better Business Bureau Concerning Publish America LLP (Maryland, USA). I've Also Included the Lengthy Customer Complaints Concerning Publish America's Shady (Unethical And Probably Illegal) Business Practices.




I list the websites of the never ending complaints against Publish America at the end of this article.




Publish America LLP is an online publishing company which promised to publish manuscripts of seeking writers. I was published in 2005. From then on fellow authors kept contacting me explaining how Publish America had "ripped them off" or "hurt" them in some way. I stayed neutral and performed my own investigation. Yes! There are massive complaints against Publish America. I'm bewildered why Consumer Protection agencies and Bureaus have not fully addressed these unethical (and properly illegal) actions of Publish America LLP.




I have contacted the Better Business Bureau and Consumer Affairs (concerning "foul" business practices) for over 30 years. No one has ever accused me of being deceptive or not obeying the rules. I am proud to have helped protect the elderly. One Attorney General's office actually sent me back the money I spent (after the Investigation and the criminals were convicted). I am very thank-ful for Consumer Protection Agencies and Better Business Bureaus which protect us consumers.




I want to print the lying, mean, and unprofessional "rebuttal" Publish America gave to the BBB. You will notice lying, deception, callousness, and no fear of being corrected. This is why I have labeled Publish America "Teflon don". They sit in their spot and feel safe. Well I'm a Man Of God. And The Reverend Has A Word For Publish America. The Bible's Babylon Had The Same Arrogance, And You See What God Did To Her. I'm not sure if Publish America still advertises for manuscripts. That company is experiencing so many fast changes. The ripples of judgment are slowing increasing. Praise God.




So here's the letter that Publish America sent to the Better Business Bureau about me (Mr. Gary Colin-Pen Name). I can assure you that THE LETTER IS ENTIRELY FALSE. THE BETTER BUSINESS BUREAU HAS EVERYTHING THAT PUBLISH AMERICA ORIGINALLY SENT TO ME REGARDING THIS OFFER. Publish America is now attempting to retrack and cover up the facts. If you or I did those things, we'd be arrested. The iconicity!




Here's Publish America's "rebuttal" to my BBB complaint:




As it turns out, Mr. Colin did not buy a paperback pursuant to PA's special. PA only sold its Paperback" pursuant to the special. Since Mr. Colin did not use the coupon code for the paperback special, PA did not send him a paperback. Furthermore, Mr. Colin did not comply with the paperback special rules. Those rules required a purchase of at least TWO (2) copies. Mr. Colin only purchased one copy. Since Mr. Colin did not act in a reasonable manner in any way, shape or form, he is going to have to live with the copy of the book that was sent to him. PA cannot be expected to reimburse Mr. Colin for a mistake that was caused solely by Mr. Colin's own unreasonable actions.




Readers and people who know me know that I don't play games. I don't hide my emotions. I am a true LEO. Publish America's statement is an outright LIE! They also lied when they told the authorities that they paid me royalties for a check I never received. IF YOU NOTICE, PUBLISH AMERICA NEVER HAS TO PROVE WHAT THEY SAY. YET, THE VICTIM, THE CUSTOMER DOES. This is very strange and very "ironic". "Teflon Don".




Well I'm Done. God will deal with Publish America and those who strengthen the seal.

Reasons for this rating include:

According to the company, "Publish America authors are not consumers." Publish America's statement of the relationship between publisher and author is that authors "transfer their book rights to Publish America in exchange for the payment of royalties for any sales of that book made by Publish America." Authors are involved in a "commercial transaction" for profit from the sale of their work. According to the company, "Authors are expected to assist with the promotion of their books."

The contractual commitment is lengthy, so authors who have questions about their ability to cancel the contract or to pursue any dispute that may arise from the agreement, should contact the company directly concerning that information before signing the contract.

Authors considering signing a contract with Publish America should read the FAQ's at publishamerica.com before doing so.

The company states that the main terms of the contract are:
1. They will pay authors "climbing royalties" starting at 8%.
2. The author retains the copyright to the work as well as movie and audio rights.
3. "A symbolic $1 advance underlines that all financial risk is carried by the Publisher...."

The company states that the books they publish are "available" to bookstores everywhere, which generally means Publish America books can be "ordered" through various booksellers, but the company readily admits "bookstores cannot possibly stock all new books." According to the company, "Publish America does not guarantee placement of its titles on bookstore shelves."

Authors should be aware that some bookstores may not agree to carry "print on demand" books from Publish America because not all unsold books can be returned to Publish America.

According to information provided to BBB by Publish America, every six months they provide each author a statement which reflects the number of books for which they have received payment and also pays the author "a percentage of those proceeds based on the contract terms." According to the company, authors who believe the statement does not properly reflect all the sales of their book, or believe they have not received the correct royalty payment, should provide documentation to Publish America that support any such claims.
